Define the Exact Authority
The document should identify the owner, agent, vehicle and permitted actions. Authority to apply for a title does not automatically authorize sale, gifting, lien satisfaction or odometer disclosure.
Common Florida Forms
HSMV 82053 is commonly used for motor vehicle, mobile home or vessel power of attorney. HSMV 82995 addresses a narrower motor vehicle POA/odometer scenario. Follow the current form instructions and procedure rather than copying an old form from a blog.
Odometer Restrictions
Federal law limits when one party can appoint another to disclose mileage. The secure sequence prevents a dealer or agent from inventing a mileage statement after seeing title documents. Never leave the mileage blank.
Identity, Signature and Notarization
Use names exactly as shown on the title, include the VIN, sign in the correct capacity and provide identity evidence. Some documents or transaction types can require notarization or an identity affidavit.
Conflicts of Interest
An agent should not use a POA to hide the real seller, transfer a vehicle to themselves without clear authority, defeat a lien or conceal title brands. Dealers must follow dealer and odometer rules in addition to the POA.
Revocation and Recordkeeping
Revoke authority in writing when appropriate and notify the agent, lender, dealer and office. Keep the executed POA, title application and receipt. A revocation may not undo an already completed authorized transaction.
