First determine whether the title is electronic, merely lost, held because of a lien, issued in another state or genuinely unavailable. Request paper, obtain a duplicate, satisfy the lien or complete the title-determination process before taking full payment.

The Title May Be Electronic, Not Missing
Check the official Florida vehicle record. If the title is electronic and clear, request a paper certificate or use the approved e-title transfer process. Do not tell the buyer that a screenshot or registration is the title.
Lost Paper Title
The titled owner can apply for a duplicate using HSMV 82101 or the eligible online process. Order it before advertising the vehicle. A duplicate request can reveal an active lien, address issue or ownership mismatch that must be fixed.
Title Held by a Lienholder
Obtain a written payoff statement and coordinate lien satisfaction. If the buyer’s money will pay the loan, use a controlled closing with the lender. Do not accept payment and promise that the lender will “eventually mail” clear title without a documented plan.
Seller Is Not the Titled Owner
A private sale generally cannot skip from a prior titled owner directly to a new buyer through an open assignment. Estates, companies, trusts, divorce orders and powers of attorney require specific authority. A person who never titled the vehicle should correct that before resale.
Abandoned or Paperwork-Only Claims
Possession, storage, repairs or a handwritten receipt do not automatically create title rights. Towing, storage-lien, landlord, court-order and bonded-title procedures have strict eligibility and notice requirements. Do not fabricate a bill of sale or use an unrelated vehicle’s VIN.
Buyer Warning Signs
- Price far below market with “easy bonded title” promise
- Seller name absent from title
- VIN plate damaged or inconsistent
- Only a registration or photocopy offered
- Seller refuses an office meeting
- Payment demanded before duplicate title arrives
